Can my ex’s trust fund be garnished for child support arrears?

EYE BYTE asked:

My ex hasn’t paid support for about 2 year’s. I know he has a trust, but that’s the only info. He won’t work, and the trust was from his father passing about 3 year’s ago. He owe’s about $18,000 now for our 3 children. He has a writ, (arrest warrant) on him now for failure to appear in court for not paying. Just wondering if anyone has any information regaurding this situation. Thank You!

Yes, the trust can be garnished, but you would need to know where it is and what exactly the names are on the trust. It is likely being held in a bank, and administered by a trustee. You need to know who the trustee is, and which bank it is in, so that they can be served notice of the lawsuit.

If you hire an attorney to enforce the support they will likely have access to an investigator to find our exactly where it is.

    Good Luck
